Welcome to Dream Drive Technologies (Pty) Ltd ("Dream Drive," "we", "our", "us", or the "Promoter") and our website www.dreamdrive.co.za ("Website"). Dream Drive offers a platform in South Africa that enables a participant ("Participant", "you") to purchase tickets that gives the Participant access to an online game of "spot the ball" that uses the Participant's skill, allowing participants the chance to win a car and/or other prizes. The Dream Drive services include operating the platform, the game and the competition and all its associated services (collectively the "Services").

By using this Website and the Services offered by us you are agreeing to these legally binding Terms and Conditions (including the Privacy Policy and Cookie Policy that can also be found on our Website) (collectively the "Terms"). Please read these Terms carefully and should you have enquiries, please contact us.

There may be legal notices on other areas of this Website (including, but not limited to the Privacy Policy) which relate to your use of the Website and/or the Services offered by us, all of which will, together with these Terms, as may be amended from time to time, govern your use of this Website as well as the Services. By accessing, browsing, using or registering for our Services on the Website, you confirm that you have read, understood and agree to these Terms, as updated from time to time, in their entirety. If you do not agree to all of these Terms, you must not use this Website or any Services related thereto.

QUALIFYING PERSONS
1. Participants must meet the following criteria to qualify for entry into the Dream Drive competition ("Competition"):
  1. Age Requirement: Participants must be 18 years of age or older.
  2. Residency: Participants must be residents of South Africa to be eligible for entry. Proof of residency may be required.
  3. Exclusion of Specific Individuals: The following individuals are ineligible to participate in the Competition:
    1. Employees of Dream Drive.
    2. Members of the immediate family of Dream Drive employees. Immediate family includes spouses, parents, children, siblings, and their respective spouses.
    3. Agents or representatives of Dream Drive.
    4. Any person who is connected with the creation or administration of Dream Drive Competitions.
2. Participants found by the Promoter to be in violation of these eligibility criteria will be disqualified from any Competition, and any prizes awarded will be forfeited. The Promoter reserves the right to request proof of eligibility and to verify the identity and age of any participant.
LEGAL UNDERTAKING
1. By entering the Dream Drive Competition, the Participant warrants that he/she has legal capacity to do so, have read and understood these Terms, and will be bound by them and by any other requirements set out in any related promotional material.
2. These Competitions are governed by South African Law, and any matters relating to the Competition will be resolved under South African Law, and the Courts of South Africa shall have exclusive jurisdiction.
3. If you participate in a Competition online via the Dream Drive Website, and by accepting these Terms, you confirm and warrant that you are not breaching any laws in South Africa regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Participant entering any of our Competitions unlawfully. If in any doubt, you should immediately leave the Dream Drive Website and check with the relevant authorities.
COMPETITION ENTRY PROCESS
1. Participants can enter the Competition by purchasing tickets and participating in the skill-based game (Spot the Ball) as outlined in the competition guidelines.
2. Availability and pricing of Competitions and tickets are at the discretion of the Promoter and will be specified at the point of sale.
3. Participants are responsible for ensuring they have read and understood the specific details and requirements associated with each Competition, including the availability, pricing, and any additional terms communicated at the point of sale.
CUSTOMER ACCOUNT WITH DREAM DRIVE
1. In order to enter a Competition, you will need to register an account with Dream Drive ("Dream Drive Account").
  1. You cannot have both an email address and a Social Media Account linked to your Dream Drive Account.
  2. You cannot have two or more email addresses linked to your Dream Drive Account.
  3. To register an account online, you will be required to provide an email address or sign in via a social media account, such as Facebook, Apple, Twitter, or Google ('Social Media Account').
  4. Your email address or Social Media Account will serve as the username for logging into your Dream Drive Account. Each Dream Drive Account can only have one username attributed to it at any given time.
  5. Please note the following regarding the username and Social Media Account: You have the option to change your username for your Dream Drive Account by logging in. For example, you can create your Dream Drive Account using one email address and later change your username to another email address. However, if you create multiple accounts using different email addresses or Social Media Accounts, each username will be treated as a separate Dream Drive Account.
DREAM DRIVE COMPETITION
1. A Dream Drive Competition involves using your skill to select a pixel closest to that chosen by a panel of Judges in the skill-based game.
2. Entries (tickets) for the Dream Drive Competition are subject to the following conditions:
  1. Entry and single account limit: Entries are limited to one hundred (100) tickets per person, per Competition, excluding any Free Dream Drive Issued Tickets.
  2. Abuse of Limit: Abuse of this limit, such as entering a Competition using multiple accounts, will not be tolerated. If the Promoter has grounds to believe that an individual is exceeding this limit, it reserves the right, at its sole discretion:
    1. to void any orders;
    2. to void any Dream Drive Credit or prize won;
    3. to award any prize to the next closest entrant;
    4. to void any tickets without notice, firstly on a chronological basis with respect to orders, and thereafter on a sequential basis with respect to ticket references contained within an order;
    5. to void any tickets exceeding the first 100 paid tickets entered into the Competition.
3. Free Dream Drive Tickets:
  1. Free Dream Drive Tickets may be offered as part of Dream Drive's Loyalty program.
  2. These tickets do not count towards the limit of one hundred (100) entries per person, per Competition.
4. Participants are responsible for monitoring their entries and ensuring compliance with the specified entry limits. Any breach of these limits may result in disqualification, voiding of orders, Dream Drive Credit, or prize awards.
COMPETITION PERIODS
1. Details regarding the start and end dates of each Competition period ("Competition Period") will be specified by the Promoter on the Website, and by purchasing a ticket and entering the Competition, you agree to these dates.
COMPETITION JUDGMENT
1. After each Competition concludes, the position of the centre of the ball will be determined by our independent panel of judges – experts in the field of football (soccer) appointed by Dream Drive (the "Judges"). The Judges' determination of the position of the centre of the ball ("Judges' Position") will be made using their football (soccer) and other expertise and the process is overseen by a qualified legal expert appointed by Dream Drive and a representative from Dream Drive.
2. Within forty-eight (48) hours of a Competition's end, the Judge's Position will be compared against the database of coordinates for that competition. This mathematical process determines which valid and eligible entry is closest to the Judge's Position, thereby identifying the winning Participant (the "First Prize Winner"). The First Prize Winner is the person who correctly identifies the Judge's Position or, if no one correctly chooses the same pixel, the Participant who is closest to the pixel. The distance is measured by calculating the straight-line distance from each valid and eligible entry to the Judge's Position ("Distance").
3. Tie-Break Mechanism: In the event that two or more valid and eligible entries are equally close to, or exactly match, the Judges' Position (each a "Tie-Break Entry"), the following structured process will apply to determine a single First Prize Winner.
  1. Step 1: Additional Entries Comparison (if applicable)
    If all of the Participants involved in the tie-break have made two or more entries into the same Competition:
    - All other entries made by each relevant Participant (excluding the Tie-Break Entry) will be reviewed and ranked based on their proximity to the Judged Position.
    - The Participant with the closest next-best entry will be provisionally placed in the lead.
    - If this also results in a tie, the comparison will continue using each Participant's next closest entry, in descending order of proximity.
    - This continues until a clear winner emerges or until one or more Participants no longer have any entries remaining for comparison.
    - There is no requirement for all Participants to have submitted the same number of entries.
  2. Step 2: Expert Review (Judges' Decision)
    If the tie remains unresolved - either because all other entries have been exhausted or because Participants submitted only one entry - then:
    - The tied entries will be reviewed again by the original Judges.
    - The Judges will assess the image context (including body language, eyelines, posture, and sporting logic) and select the entry they believe most accurately reflects the correct coordinate.
    - This decision will be made via a simple majority vote, and the Judges' decision at this stage is final and binding.
  3. Step 3: Sudden Death Challenge (New Spot the Ball Round)
    If the Judges are unable to agree on a winner during the expert review process (e.g., a tie in votes), then:
    - All tied Participants will be invited to complete a new Spot the Ball challenge using a different image.
    - This new image will be judged under the same terms as the original, with no further payment required.
    - If a tie still results after this round, the process may be repeated using new images until a single winner is determined.
    - If a tied Participant cannot be reached within 72 hours of first contact, they will forfeit their place in the tie-break process and the challenge will proceed with the remaining Participants.
  4. Runner-Up Recognition
    1. At the sole discretion of Dream Drive, tied entrants who do not ultimately win may be awarded a runner-up prize (explicitly not a vehicle) or Dream Drive Credit as a token of recognition for reaching the final stage.
WINNERS DETAILS
1. Dream Drive takes the verification of winners ("Winners") seriously. To confirm their identity, age, and ownership or authorization to use the credit card used for the purchase of tickets, Winners will be required to submit a copy of their South African Identity Document or passport to Dream Drive before any prize is paid or delivered. Failure to fulfil these obligations may result in disqualification, and Dream Drive reserves the right to choose an alternate winner.
2. In addition to verification requirements, all Winners will be asked to provide photographs and/or pose for photographs and videos. These media may be utilized in future marketing and public relations efforts by Dream Drive, highlighting the Winners and their achievements in connection with the competition. Winners have the right to refuse to do so.
3. After the Promoter receives and verifies the necessary details, the Winners will be contacted to arrange the delivery of the prize. At this stage, Winners must choose from the available prizes, as outlined in the Competition prize information on the Dream Drive website. The chosen prize must be communicated to Dream Drive in writing.
4. Surprise Contact Details: In the account settings, you have the option to add the contact details of an individual whom Dream Drive can contact to assist with surprise arrangements if you are a Winner. Dream Drive guarantees not to share or process these contact details for any other purpose without explicit consent.
MARKETING CONSENT
1. Winners consent to the use of their name, image, and content related to receiving the vehicle for marketing and promotional purposes by the Promoter. Winners have the right to refuse to do so.
COMPETITION PRIZES
1. A Competition depicts various cars, but after each Competition Period only one principal prize will be awarded for each Competition ("First Prize"). For the avoidance of doubt, not all of the cars featured are given away at the end of each Competition Period, but only the car that is linked to the ticket that is closest to the Judges' position, as determined and outlined above. Prizes other than the First Prize may also be awarded to runners-up in the sole discretion of the Promoter.
  1. During a Dream Drive Competition, if circumstances beyond Dream Drive's control prevent the delivery of the stated First Prize, Dream Drive has and reserves the right to award a substitute car of equal or greater value.
  2. If the First Prize Winner chooses a car, an order will be placed by Dream Drive. Delivery may take up to (or exceed) 12 months for certain cars, depending on availability from car dealers, and cars will be ordered in basic specification. All cars will typically be ordered in South Africa from South African dealers. Bespoke options and upgrades can be added at the First Prize Winner's request, but the cost of such options and upgrades must be paid for in advance by the First Prize Winner.
  3. In South Africa, the First Prize will be delivered with South African VAT paid.
  4. The maximum value that Dream Drive will be liable to pay for or towards any First Prize is the South African Recommended Retail Price of the First Prize as advertised on our website, and any amounts over and above that will be for the account of the First Prize Winner. Dream Drive will only transact with manufacturer-recommended principal dealers.
  5. For Competitions featuring vehicles within the "Classic Icons" range, which refers to a curated selection of collectible and iconic cars that are acquired pre-owned, the prize shall be limited to sourcing a model reasonably equivalent to the one listed, with the total value not exceeding the Retail Price as advertised at the time of entry. Due to the nature of sourcing vintage vehicles, the specific car delivered may differ in exact specification.
2. Dream Drive Competition Cash Alternative: If a Dream Drive Competition Winner prefers not to take delivery of one of the First Prizes, the Dream Drive Competition Cash Alternative can be claimed. The Cash Alternative is 80% of the stated market value of the car(s) (rounded to the nearest R1,000. The delivery of the Cash Alternative will be paid to the winner within 6 months of election of the Cash Alternative.
3. Runners Up Prizes: Runners Up may each be awarded other tangible items (explicitly not a vehicle) or Dream Miles for Dream Drive Competitions run by Dream Drive at the discretion of the Promoter.
DREAM MILES
1. Dream Miles rewards ("Dream Miles") can be earned by you as stipulated by Dream Drive on the Website from time to time, including but not limited to purchasing certain volumes of tickets, following and sharing social media pages as stipulated by Dream Drive and/or referring a friend to Dream Drive, as stipulated by Dream Drive from time to time.
2. No additional consideration is payable by you to Dream Drive to earn Dream Miles – you only have to comply with the requirements set by Dream Drive on the Website from time to time in order to earn Dream Miles.
3. Dream Miles do not expire and can be used to obtain discounts on ticket prices or access other benefits, as stipulated by Dream Drive on the Website from time to time.
WINNERS' PERSONAL DATA
1. Subject to the right to refuse hereinbefore detailed, the acceptance of the prize by the Winner signifies their consent to undergo photographic and video documentation by Dream Drive for promotional purposes, encompassing Public Relations and Marketing. This obligation extends to both immediate post-win documentation and potential future utilization, subject to the provisions of the Privacy Policy and the legislation mentioned in the Privacy Policy.
2. By entering a Dream Drive Competition, participants expressly agree to the utilization of their name, address, and/or photographic or other likenesses. Furthermore, participants commit to attending publicity events without any additional compensation, excluding reasonable travel expenses, subject to the provisions of the Privacy Policy and the legislation mentioned in the Privacy Policy.
LIMITS OF LIABILITY
TO THE EXTENT PERMITTED BY LAW:
1. Dream Drive emphasizes that it makes no representations or warranties regarding the quality or suitability of any goods or services offered as prizes. The Promoter expressly disclaims any responsibility in this regard.
2. Except for liability for death or personal injury resulting from the negligence of Dream Drive, the Promoter shall not be held liable for any loss suffered or sustained, whether to person or property. This includes, but is not limited to, direct and indirect or consequential losses, whether of an economic nature or otherwise, arising from any act or omission by Dream Drive, its servants, or agents. This extends to all aspects connected with the arrangement for supply or the actual supply of any goods by any entity to the prize Winner(s). Similarly, Dream Drive disclaims liability for any losses incurred by any family or persons accompanying the Winner(s). This limitation of liability also encompasses any events or circumstances related to the Competitions promoted by Dream Drive.
3. In addition to any other indemnities provided in these terms, you hereby unconditionally and irrevocably indemnify Dream Drive, our officers, agents, directors and employees and agree to hold us free from all loss, damages, claims and/or costs, of whatsoever nature suffered or incurred by us or instituted against us for infringement of any right, whether the claim or action arises from delict or contract, or any infringement of whatsoever nature, arising out of or pursuant to the exercise by you of your rights or the fulfilment or breach by you of any of your obligations under these Terms or any other requirements that we may impose from time to time, including, without limitation, all loss, damages, claims and/or costs suffered or incurred by us or instituted against us as a direct or indirect result of your use of the Website or participation in a Competition, and such indemnity shall extend to the reasonable costs that may be incurred by us in defending any action instituted against us. Your use of the Website, Services and/or your customer profile is entirely at your own risk and you assume full responsibility and risk of loss resulting from the use thereof. we do not accept liability that may arise in connection therewith.
4. Dream Drive, our affiliates, shareholders, directors, agents, consultants or employees shall not be liable for any damages whatsoever, including without limitation any direct, indirect, special, incidental, consequential or punitive damages, howsoever arising (whether in an action arising out of contract, statute, delict or otherwise) related to the access to and/or use of, or the inability to access or use, the Website, any personalised item and/or any linked website, the content thereof, any functionality thereof or information contained therein.
ELECTRONIC COMMUNICATIONS
1. Dream Drive shall not be held responsible for any failed, partial, or garbled computer transmissions, including but not limited to any malfunctions, failures, or connections related to computer, telephone, cable, network, electronic, or internet hardware or software. This includes acts or omissions of any service provider, issues related to internet accessibility or availability, and instances of traffic congestion or unauthorized human acts, such as errors or mistakes. While Dream Drive will make reasonable efforts to award the prize to the correct Entrant, in cases where hardware, software, or other computer-related failures, or human errors result in the incorrect awarding of the prize, Dream Drive reserves the right to reclaim the Competition prize. The prize will then be awarded to the correct Entrant at Dream Drive's sole discretion, without admission of liability.
2. Dream Drive has and reserves the right, at its sole discretion, to extend the closing date of any Competition if any aspect of the competition is disrupted due to factors beyond control. Such factors may include computer virus infection, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures, or any cause that corrupts or impacts the administration, security, fairness, integrity, or proper conduct of the Competition. Dream Drive may, at its sole discretion, cancel, terminate, modify, or suspend a Competition, or invalidate any affected entries. In cases where Dream Drive closes a Competition early, the Winner may be selected from all valid and eligible Entries received prior to the closure date. However, Dream Drive reserves the right to close a Competition early without selecting a Winner. If a Competition is closed without selecting a Winner, Dream Drive will provide all entrants with Dream Drive Credits to allow them to replay equivalent tickets in a subsequent Competition.
3. Dream Drive shall not be liable for any economic or other consequential loss incurred by individuals to whom an award has been incorrectly made, and no compensation shall be owed. Dream Drive is committed to ensuring the correct and accurate performance of the software and website(s) used to operate its Competitions across the latest versions of popular internet, tablet, and mobile browsers. It is emphasized that only the ticket coordinates recorded in our systems, however displayed or calculated, will be entered into the relevant Competition. Dream Drive will not be held responsible for any Competition entries resulting from malfunctioning software or other events. Entrants can verify Competition coordinates at any time by accessing their account on the Dream Drive website.
DATA PROTECTION NOTICE
1. Dream Drive places the utmost importance on the protection and proper usage of your personal data. Any personal data you provide to Dream Drive will be dealt with as outlined in the Privacy Policy.
DISPUTE RESOLUTION AND FINALITY OF JUDGING
1. Winners are chosen by an independent judging panel, as outlined above in clause 7. Their decision is final and cannot be appealed. We will not re-open judging decisions once made. In the event of a technical or procedural error, Dream Drive reserves the right to amend results at its sole discretion to reflect the correct outcome.
ENTRY FRAUD AND ABUSE PREVENTION
1. Dream Drive reserves the right to disqualify any entrant or void any entry that, in its sole discretion, is suspected of breaching these Terms or manipulating the system. Prohibited conduct includes, but is not limited to:
  - Creating multiple accounts to exceed entry limits
  - Using automated tools, bots, or scripts to submit entries
  - Coordinated entry purchasing to gain unfair advantage
  - Attempting to exploit technical vulnerabilities or errors
  Where fraudulent behaviour is identified, Dream Drive may take further legal action and permanently restrict access to the platform.
AMENDMENTS TO TERMS
1. Dream Drive reserves the right to amend these Terms and Conditions at any time. In the event of a material change, notice will be provided via the website or through email. Continued participation following any amendment constitutes acceptance of the updated Terms.
PROMOTER
1. The contact and other details of the Promoter are reflected in the Privacy Policy.
